In what has come as a setback in the medical industry, the Central Board of Direct Taxes (CBDT) has accused the makers of Dolo-650 tablets of spending Rs 1,000 crore for distributing free gifts to doctors for prescribing the drug.

The Federation of Medical and Sales Representatives Association of India submitted that the pharma company manufacturing the fever reducer Dolo tablet had invested Rs. 1,000 crore for free to prescribe them to patients.

Justice DY Chandrachud, who is heading the Supreme Court bench, said that this is a serious issue. "It's not music to my ears. I was told to do the same even when I had Covid. This is a serious issue and matter," he was quoted as saying by B&B.

The Supreme Court was hearing a PIL seeking a direction to make pharmaceutical companies liable to give freebies to doctors as an incentive to prescribe their medicines.

The petition by the Federation of Medical and Sales Representative Association of India has sought a direction to give statutory backing to the Uniform Code of Pharmaceutical Marketing Practices (UCPMP).

The petitioner cited the high sale and prescription of drug Remdesivir during the COVID-19 pandemic as an example.

Last month, the Income Tax Department had raided the office of Micro Labs Limited, a Dolo-650 manufacturer.

At present, no law in India prohibits any such practice.

It has been said in the petition that such drugs are a threat to the life and health of the patient. It also said that in this situation, the customer pays for branded drugs that are "overprescribed" or "irrationally prescribed" by doctors.

It argued that giving a statutory basis to the UCPMP would provide transparency and accountability in the process.

The National Medical Commission (NMC) has sought details of doctors from the Income Tax Department who had allegedly received freebies from six pharma companies, including Micro Labs, which makes Dolo 650, against whom raids were conducted last month.

सुप्रीम कोर्ट की बेंच की अध्यक्षता कर रहे जस्टिस डीवाई चंद्रचूड़ ने कहा कि यह एक गंभीर मुद्दा है। "यह मेरे कानों के लिए संगीत नहीं है। मुझे भी कोविड होने पर भी ऐसा ही करने के लिए कहा गया था। यह एक गंभीर मुद्दा और मामला है," उन्होंने बी एंड बी के हवाले से कहा।

सुप्रीम कोर्ट एक जनहित याचिका पर सुनवाई कर रहा था, जिसमें दवा कंपनियों को डॉक्टरों को उनकी दवाओं को निर्धारित करने के लिए प्रोत्साहन के रूप में मुफ्त देने के लिए उत्तरदायी बनाने का निर्देश देने की मांग की गई थी।

फेडरेशन ऑफ मेडिकल एंड सेल्स रिप्रेजेंटेटिव एसोसिएशन ऑफ इंडिया की याचिका में यूनिफॉर्म कोड ऑफ फार्मास्युटिकल मार्केटिंग प्रैक्टिसेज (यूसीपीएमपी) को वैधानिक समर्थन देने का निर्देश देने की मांग की गई है।

याचिकाकर्ता ने एक उदाहरण के रूप में COVID-19 महामारी के दौरान दवा रेमडिसिविर की अत्यधिक बिक्री और नुस्खे का उदाहरण दिया।

पिछले महीने आयकर विभाग ने डोलो-650 निर्माता कंपनी माइक्रो लैब्स लिमिटेड के कार्यालय पर छापेमारी की थी।

वर्तमान में, भारत में कोई भी कानून ऐसी किसी भी प्रथा को प्रतिबंधित नहीं करता है।

याचिका में कहा गया है कि इस तरह की दवाएं मरीज के जीवन और स्वास्थ्य के लिए खतरा हैं। इसने यह भी कहा कि इस स्थिति में, ग्राहक ब्रांडेड दवाओं के लिए भुगतान करता है जो डॉक्टरों द्वारा "अधिक निर्धारित" या "तर्कहीन रूप से निर्धारित" हैं।

इसने तर्क दिया कि यूसीपीएमपी को वैधानिक आधार देने से प्रक्रिया में पारदर्शिता और जवाबदेही मिलेगी।

राष्ट्रीय चिकित्सा आयोग (एनएमसी) ने आयकर विभाग से उन डॉक्टरों का ब्योरा मांगा है, जिन्होंने डोलो 650 बनाने वाली माइक्रो लैब्स सहित छह फार्मा कंपनियों से कथित तौर पर मुफ्त उपहार प्राप्त किए थे, जिनके खिलाफ पिछले महीने छापेमारी की गई थी।
